1. General
These Terms & Conditions (“Terms”) apply to all orders placed with Shutters of Elegance Limited (“we”, “our”, “us”). By placing an order, you agree to be bound by them. Any variation must be agreed in writing.
2. Quotations
- All quotations are valid for 30 days from the date issued.
- Quotes are based on current supplier and shipping costs and may be revised if specifications change or if supplier pricing is updated.
- Quotations are invitations to place an order, not binding offers. An order is only confirmed once we have accepted it in writing and received your deposit.
3. Measuring & Design Service
- We offer a free first home visit for measuring and design advice.
- If a second visit is requested before an order is placed, a charge may apply.
- Once an order is placed, a final detailed survey will be carried out. Customers must ensure access is available and windows are clear of obstructions.
4. Bespoke Product Disclaimer
- All shutters are made-to-measure to your specific window sizes.
- Once production has started, orders cannot be cancelled, amended, or refunded.
- Returns are only accepted if goods are proven to be faulty.
- As wood is a natural material, variations in grain, finish, or shade are normal and not considered defects.
5. Order Confirmation & Payment
- A 50% deposit is required to confirm your order.
- The balance must be paid in full before or on the day of installation.
- We accept payment by bank transfer, debit card, or credit card.
- Failure to make payment on time may result in delayed installation or additional charges.
6. Production & Lead Times
- Typical lead times are 6–14 weeks, depending on product range and factory schedules.
- Lead times are estimates only. Delays caused by shipping, customs, weather, or supplier issues are outside our control and do not entitle you to cancel or claim compensation.
7. Delivery, Installation & Storage
- We will contact you once your shutters are ready to arrange installation.
- You (or your representative) must be present during installation to confirm satisfactory completion unless agreed otherwise in advance.
- Any damage or defect must be reported within 48 hours of installation.
- If shutters are ready but installation cannot take place due to customer availability, we can store them free of charge for up to 30 days. After this, a storage fee of £30 + VAT per week may apply.
8. Fitting Conditions & Limitations
- Shutters are not blackout products; small light gaps are normal.
- Mid-rail positions may vary by up to 5% unless ordered as “critical.”
- Trim may be used to compensate for uneven window surrounds; this is not considered a defect.
- If installation is carried out against our professional advice, liability for the result transfers to the customer.
9. Tolerances & Material Disclaimer
- Shutters may expand or contract slightly due to humidity. This is normal.
- Minor imperfections not visible from 1.5 metres in natural light are not considered defects.
- Fading from direct sunlight, or damage from moisture/humidity, is not covered under warranty. For damp environments, we recommend PVC shutters (e.g. Vienna range).
10. Warranty
- All shutters are covered by a manufacturer’s warranty. This is not provided by Shutters of Elegance Limited.
- We will assist you in making any warranty claim with the manufacturer.
- We do not accept liability ourselves, and if the manufacturer ceases trading or is unable to honour the warranty, Shutters of Elegance is under no obligation to repair, replace, or compensate.
- The warranty does not cover:
- normal wear and tear
- fading due to sunlight
- exposure to damp or unsuitable conditions
- misuse, accidental damage, or alterations made after installation
11. Photography & Marketing
We may take photographs of completed installations for quality control and, unless you object, for use in our marketing (e.g. website, social media). If you do not wish your images to be used for promotional purposes, please inform us at the time of installation.
12. Liability
- Our liability is limited to the value of your order.
- We are not responsible for consequential losses (e.g. redecorating, third-party installation costs, or compensation for delays).
- If remedial work is required, you must allow us to carry it out. We will not be liable for costs of third-party repairs unless agreed in writing.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence.
13. Consumer Rights
Nothing in these Terms affects your statutory rights under UK consumer law.
14. Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
